Section 32 statement is an important part of any real estate transaction. It’s a legal document given by the seller of a property to the interested buyer. When you buy or sell real estate, it doesn’t need to be complex, but there are some specific things you need to pay attention to ensure the whole buying or selling process is as smooth as possible:
𝟏. 𝐙𝐨𝐧𝐢𝐧𝐠𝐬
Knowing your property’s zoning is important, as it decide what can and can’t be developed on it. It can greatly affect your future plan, especially if when you are buying it as an investment. For example, with the Residential Growth Zone, you can buy a big land to build several units and lease them.
𝟐. 𝐂𝐞𝐫𝐭𝐢𝐟𝐢𝐜𝐚𝐭𝐞 𝐨𝐟 𝐓𝐢𝐭𝐥𝐞
Title proves the right to own and sell the property lawfully of the vendor. When checking the Certificate of title, you need to carefully consider the covenants, caveat, plan of subdivision and the sewerage plans.
𝟑. 𝐎𝐮𝐭𝐠𝐨𝐢𝐧𝐠𝐬
Outgoings include the rates associated with the property, such us fees for body corporate, garbage, water, and land tax. You need to be aware of all the costs that may incur in the future after owning the property.
𝟒. 𝐁𝐮𝐢𝐥𝐝𝐢𝐧𝐠 𝐩𝐞𝐫𝐦𝐢𝐭𝐬 𝐢𝐬𝐬𝐮𝐞𝐝 𝐢𝐧 𝐭𝐡𝐞 𝐥𝐚𝐬𝐭 𝟕 𝐲𝐞𝐚𝐫𝐬
With any house’s renovation or extension works in the last 7 years (such as: new Al fresco, toilet room, etc., which made the house different from the original floor plan, the seller needs to provide Building approvals or Building permit of those works. If this information is not included in Section 32, the question here will be: who completed the renovation, and why didn’t they apply for a Building Permit? If the vendor was home-builder, they also need to provide the Owner Builder Report and Certificate of Final Inspection. If the house was built within the last 7 years, in addition to a Building Permits, the vendor needs to present an Occupancy Permits, and Warranty Insurance.

Proceeding “subject to finance” is the preferable option where finance has not been approved unconditionally.

Of course, there is the risk that the property may sell to a purchaser who offers to buy the property unconditionally, but in most cases, the vendor will opt for the higher price, rather than a lower but unconditional offer.

A subject to finance clause is a clause that’s intended to protect the purchaser. It states that your agreement to buy a property is subject to obtaining the finance you’ll need to go ahead with the purchase.

This clause makes the purchase conditional upon receiving finance, generally in the form of a home loan. ‘Section 27’ is actually called an Early Release of Deposit Authority. It is commonly referred to as a Section 27 as it is implemented under Section 27 of the Sale of Land Act.

Generally, when purchasing real property the purchaser will be required to pay a deposit of around 10% of the sale price. This deposit is usually held in a trust fund until Settlement, at which time it is transferred to the vendor.

If the vendor wants the deposit money prior to Settlement, they may ask for an Early Release of Deposit Authority. In order for the deposit to be released early, both parties must sign the document.

To determine whether or not an Early Release of Deposit is appropriate, it is best to seek advice from a lawyer or conveyancer.

Information to look out for in a Section 32, and why it’s important, includes:

- Copy of the title
The title proves that the vendor has the legal right to sell the property as well as what it actually is, such as a house, unit or vacant block of land. It should also include any easements, covenants, subdivisions or restrictions on the property, which can be as subtle as an easement related to sewerage or water usage.
- Outgoings
This disclosure is regarding the financial outgoings associated with the property, which can include rates or any body corporate or owners corporation fees. All buyers should be fully aware of what future regular costs they will be liable for as the new owner of the property.
- Zoning
Zoning is important to enable the buyer to understand what can and can’t be developed on the property.
- Council valuation
While this isn’t always included in a Section 32, buyers need to be aware that a council valuation may not necessarily reflect the property’s market value.
- Building permits issued in the past seven years
Building approvals would have been granted for properties with works completed recently, for example a new bathroom or kitchen.

Buying and selling real estate doesn’t need to be complicated but there are a number of legal hoops that need to be jumped through to ensure the transaction happens as smoothly as possible.
