📢 Important Deadline Alert for Holiday Parenting Arrangements! 📢

With the Christmas school holidays approaching, separated parents seeking interim parenting orders for holiday arrangements must act quickly! In the Federal Circuit and Family Court of Australia, the deadline to file is Friday, November 8, 2024, by 4 PM. ⏰

Filing after this date may mean a hearing isn’t scheduled until after Christmas, even in urgent cases. If you and the other parent can agree, a parenting plan is a great alternative to court orders—it’s a written agreement you can create together or with legal guidance.

Major changes are underway that will greatly impact the family law system. The intention of the Family Law Amendment Bill 2023, which was first introduced to Federal Parliament on 29th February 2023, is to make changes to child custody laws to make them more relevant to ensure the best interests of children.

Changes proposed by the new Bill include removing the historical presumption of equal shared parental responsibility and related equal time and substantial and significant time provisions.

Moving forward, there will be heightened focus on simplifying the list of factors that courts need to consider when determining a child’s best interests such as;

📌What arrangements would best promote the safety of the child

📌The developmental, psychological and emotional needs of the child

📌The capacity of each parent to provide for these needs
