Since 1 July, conveyancers, lawyers, accountants and real estate agents across Australia have come under the anti-money laundering and counter-terrorism financing (AML/CTF) laws. It's the biggest expansion of that regime since it began, and property is squarely in its sights — because real estate has long been one of the easiest places to hide dirty money.

By 29 July, every firm providing these services must be formally enrolled with AUSTRAC, the national financial crime regulator. It isn't optional, and it isn't paperwork — operating without it carries serious consequences.

What it means when you buy or sell 👇

🪪 Identity checks before we start. We verify who you are before we act for you — every matter, even for clients we've helped for years.

🏢 Company, trust or SMSF purchases. We identify the real people behind the structure, not just the entity name.

💬 Questions about your funds. Where your money has come from is now something we're required to ask. It's the law, not a judgement.

🗄️ Seven years of records. Those checks are documented and retained.

⏰ A little more time upfront. Get your ID and paperwork to us early and none of this will slow your settlement down.

Three questions worth asking any conveyancer right now:

Are you enrolled with AUSTRAC?
Do you have an AML/CTF program in place?
Who is your compliance officer?

A firm doing this properly will answer all three in seconds. Hesitation is worth noticing 🚩

We hear this all the time. In Victoria, it's one of the riskiest
assumptions a buyer can make.

Yes, a cooling-off period exists. But it's shorter, stricter, and
more easily lost than most people realise 👇

What actually applies to PRIVATE sales (s31, Sale of Land Act 1962):

🕒 You get 3 clear business days — and the clock starts the moment
YOU sign, even if the vendor doesn't sign until days later. Weekends
and public holidays don't count.

💸 Pulling out isn't free. The penalty is 0.2% of the purchase price
(or $100, whichever is greater). On an $800,000 home, that's $1,600.

🚫 Sometimes it doesn't apply at all. There's no cooling off at
auction — or if you sign within 3 business days before or after a
publicly advertised auction. Company buyers don't get it either.

✍️ Your notice must be in writing and served correctly. A small
mistake here can wipe out the right altogether.

The takeaway?
Cooling off is a last resort — not a safety net.

The real protection is getting the contract reviewed BEFORE you sign,
so you're never gambling on a 3-day window in the first place.

In Victoria, many buyers don’t realise the document they are signing is already the Contract of Sale. Once the Vendor signs it as well, the deal becomes legally binding.

Not an “expression of interest.”
Not something you can easily change later without penalty.
