There's a bit of a misconception that you should stay in the family home following separation no matter what, but the reality is moving out does not relinquish any interest you might have in that property and does not forfeit your parenting role. Moving out is a big step which is best undertaken following some initial family law advice (if it's safe to do so).

Wanting a second bite of the cherry?? You might be hard pressed if you're seeking this in Family Law. This turn of phrase is used by family lawyers to describe reopening a final property settlement. Getting a second go at a final property settlement (or seeking more) is generally restricted unless you can show some limited exceptions such as fraud or undue influence occurred in the first final property settlement. If you've had a final property settlement formalised by way of a consent order and you're concerned the other party engaged in fraud or undue influence to get agreement get advice from your lawyer ASAP so you understand your options.

In terms of parenting it can be relevant when considering risk, in terms of property it can be relevant in terms of wastage and it may also be a factor in family violence. The court can obtain evidence around alcohol use in various ways including urine testing for recent use and liver function and/or carbohydrate deficient transferrin testing to detect long term alcohol use and abuse.

Companion animals - that's what the Family Law Act calls them. To others they are pets or fur babies. In separation companion animals are classed as property and the court can make orders for one person to own the pet, or for ownership to to be transferred to another person who consents to the transfer or the court can order a pet be sold. It's important to note that companion animals are not assistance animals, animals kept for business, agricultural or laboratory purposes. If you're wondering whether you need to consider your fur baby in your family law separation the answer is "yes".
