Louise Moulton Legal Modern estate planning essentials and solutions Personally and professionally I have witnessed the devastating impact poorly drafted Wills can have on families.

After 15 years as a teacher and educational leader, in both public and private schools, I followed the teenage dream of practising law. My two worlds combine beautifully to educate you on the importance of a modern estate plan through plain English explanations of complex legal concepts. I am a mother of adult children in their 20s and grandmother of two toddlers who delight me with their way of l

ooking at the world. I am a working class girl from Port Kembla, Wagga Wagga and Beechworth - call me a gypsy child who loves her 80s music. My silver wedding anniversary is rapidly approaching - a relationship I think influenced by my being a child of a blended family - I value listening, talking things through and making memories. I practise pre-emptive law, that is, I want to work with you to come up with an estate plan that minimises potential conflict and dispute through careful consideration of the unique circumstances that make up your world. I have the life experience and empathy to listen to your hopes and fears, whilst turning your attention to areas of your estate that will surprise you are so important. It is likely we will have a good laugh too - I hope you don't mind a little bit of dark humour!

The Perils of DIY Wills: Lessons from a $24M Estate Battle

A recent Financial Review article highlights three cases where "homemade" wills led to costly legal battles. Sydney artist Mimi Jaksic Berger's $24M estate ended up in court due to multiple conflicting wills, including an unwitnessed codicil and a torn-up original. Similarly, entrepreneur Andrew Findlay's unsigned will and Raveica Negrean's ambiguous will both required judicial intervention.

These cases underscore why professional legal advice is critical for estate planning. As lawyer Andrew Meiliunas notes, "Engaging a qualified lawyer ensures that the testator's intentions are clearly expressed and legally enforceable."

DIY wills often overlook legal nuances, contain vague language, or fail to meet formal requirements. The consequences? Lengthy court battles, diminished estate values, and family conflict tearing relationships apart forever.

Investing in professional will preparation isn't just about legal compliance – it's about protecting your legacy and sparing your loved ones unnecessary stress during an already difficult time.
