If you're involved in a situation with an uninsured or unidentified driver, compensation is still possible.

The Nominal Defendant is a government body that will step in to pay compensation where CTP insurance from the other party is not applicable.

There is a range of strict procedures that must be undertaken to be eligible to lodge a claim, which also include tight time limits.

If you've had a previous workers' compensation claim and never completed an assessment of permanent impairment, you may be eligible for compensation.

There is no time limit to undertake the assessment, and it isn't a new claim.

A written-off car is valued, not adjudicated. The figure an insurer puts in front of you is its assessment of what the car was worth on the day, and an assessment can be questioned.

You are entitled to ask how that figure was reached and to request the information behind it, including the comparable vehicles relied on and any adjustment made for condition or kilometres.

Insurers are required to have an internal dispute process and beyond that the Australian Financial Complaints Authority considers disputes at no cost to consumers.

If you're not at fault in an accident, there are four steps you must follow to seek compensation.

Generally, your insurance company will waive your excess and contact the other party's insurance directly. If you are only covered for third-party insurance, you may need to reach out to the other party's insurance directly.

If you have any questions, reach out to us, and a solicitor will be in touch.
