Recent surveys suggest around 1 in 4 Australians have owned or currently hold cryptocurrency and while NFT ownership is lower, it’s still a growing slice of digital wealth that’s finding its way into family law matters.

The issue? These assets don’t always show up in the usual paperwork.

Bitcoin, Ethereum, NFTs and anything sitting in a digital wallet are still part of the property pool in a separation and they must be disclosed.

The courts are increasingly dealing with crypto-heavy asset pools, and “I forgot about that wallet” isn’t cutting it.

If it has value, it must be on the table. Full disclosure is what keeps settlements fair and avoids expensive headaches later.

Yes, your texts can absolutely be used in court.
Messages sent via SMS, WhatsApp, Messenger, email, and even social media DMs and posts can all be admitted as evidence in family law proceedings.

What might feel like a private vent in the moment can later become part of a much bigger picture around communication, parenting arrangements, or financial disputes.

In short: if it’s written down and can be saved or screenshot, it can potentially be shown in court.
