At Sontag Legal Solutions we also provide independent legal advice for Guarantors. This week clients contacted us as they were setting up their self managed superannuation fund, and making an investment purchase in the fund name. In order to obtain finance they needed to provide a personal guarantee to the lender that the loan would be repaid. A guaranteed comes with onerous obligations and responsibilities that you must be independently advised about prior to entering the loan contract. Our professional advice, fast service and flexible meeting options meant that the clients’ loan application was not delayed. The SMSF investment will settle later this month. Great news this week for a client from Geelong. After being estranged from his father many years ago (when his father’s Will was drafted), he had repaired the relationship but not with the sibling executor.

Sontag Legal Solutions were able to provide on going advice and negotiate a family provision agreement between the parties. We also hope it may have even been the olive branch needed to mend old broken fences.

Another busy week!!!
Notably this week we helped a widower with updating his Will and other estate planning documents. He wanted to expressly omit an otherwise relevant person from any provision of his estate. To ensure his major assets were completely quarantined from his estate, we advised him to ajust the manner of holding of his residence. He now has the piece of mind that his hard earned assets will be directed in accordance with his wishes and minimise the risk of a family provision challenge to his estate.
