An application for a grant should generally be made within six months of the date of death.
If more than six months have passed, the Court will usually require an explanation for the delay before it makes the grant. It is not a bar to applying, but it does add an extra step and can hold things up further.
Delay tends to compound. Assets sit frozen, bills go unpaid, and beneficiaries wait. If time has already passed since your loved one died, it is not too late to get moving. Contact VC Lawyers for practical guidance, visit https://www.vclawyers.com.au/wills-probates-and-family-provision-act-claims/.
