As a young person I had the idea that making a Will was something one did as they entered the latter part of their life. Many young, and middle aged, Australians have the same thoughts as I did. However, death does not play favourites, and any one of us could breathe our last breath at any moment. Having worked in the Trustee industry for 19 years administering deceased estates I found out first hand that young and middle aged people do pass away. You and I need to be prepared for what life throws at us and that includes end of life stuff. I have been musing over the panic buying of toilet paper due to the corona virus. How quick we are to attend to what we believe to be our immediate needs yet fail to give much thought to future outcomes? A Common Myth About Wills.

My family know what I want. They will take care of things when I’m gone (including who will look after my children).

The Truth:
Without a will, your family will lack the power to make many important decisions.
They will be bound by what the Law dictates about things such as who will administer your affairs, who will get your assets, when they get those assets, and who will have legal authority to look after your children.

None of us know what tomorrow may bring. In fact, we are not promised a tomorrow. I interviewed a couple this week in relation to their wills. The husband shared with me that he is thankful to be alive after surviving a massive heart attack last year. What startled me was that this man was only 38 years of age with a wife and 2 young children. Needless to say, this event shocked them into getting their Wills and other estate planning documents in order.

Why is it that we leave things undone believing that we are invincible and have many more years ahead of us? For this man it could have been all over in a heartbeat last year. Have you given any thought as to what would happen to your family if your life was cut short today? Will you leave a mess behind which your loved ones will need to clear up or will you have everything in place to make it as easy at it can be for them to move through a difficult time?

Another year has ticked over and we already find ourselves 17 days into 2019 (long enough for most new years resolutions to be broken). It may be that your new years resolution is to get your financial affairs in order. And for this I would commend you. I would remind you that part of being prepared financially is to secure your estate should you die suddenly, or indeed, become mentally incapacitated.
I have already had a number of people in the past 17 days indicate to me that they need to use my services to put their Wills and other estate planning documents in order. Unfortunately, I hear this a lot but, more often than not, it does not translate into actual fact. Maybe you are one such person, who has had good intentions to attend to this important matter but have not yet got around to making it reality. Have you read the post about Aretha Franklin dying without a Will, leaving her estate's future uncertain?
Apparently, the "Queen of Soul's" worth is estimated to be approximately $80 million US$ yet she did not leave a will.
The question of what happens to Franklin's estate remains murky. According to intestacy laws in Michigan - the state where the singer lived most of her life, and where she died - her four children should receive equal shares of it. But the article goes on to say when a celebrity dies, it is not uncommon for people to make claims on the estate that can potentially lead to legal battles which eat away the estate's assets. Prince is a case in point.
One of Aretha's lawyers tried to convince her that she should prepare a Will to safe-guard her estate and she knew the importance of doing so, however it just didn't seem to be something she got around to.
As I have said in a previous post, "Not having a will is a very common occurrence. People do not like to face their mortality.
How about you? Do you have a current Will, and other estate planning documents in place? Don't leave it too late like Aretha Franklin and Prince. It may well be that the distribution of your estate under South Australian intestacy laws may not end up with those who you want to leave it to.

Over the past few weeks I have been reminded of the Aussie saying of "She'll be right mate" when it comes to making important decisions. However, when it comes to "putting off" making a Will, this saying can be costly.
With our comfortable lifestyles many Australians do not like to talk about death and dying, yet this reality of life can hit all of us, in some way or another, when we least expect it.
I received a couple of phone calls recently informing me of the passing of loved ones, who in the months preceding their death had every intention of making a Will or updating there existing Will but never got around to it. This, of course, left the families in a predicament which they then needed to sort out. Luckily, for one party, they were contacted by a Trustee Company to advise them of an old Will that was made by the deceased many years ago and which, fortunately for them, had clauses in it that benefited the right beneficiaries.
My advice to you all is "Don't leave this important business undone". If you are 18 years of age or older, it is never too early to put your Will in place as we have no guarantee of a tomorrow. Why not give me a call on m. 0410 038 977 to start the ball rolling?
