📜 What happens to your estate if you die without a valid Will?

In 2025, Australia recorded 188,421 registered deaths. While this doesn't tell us how many people died without a Will, it highlights how important estate planning can be.

Without a valid Will, intestacy laws determine who inherits your estate. The outcome may not reflect your wishes and could create additional uncertainty for your loved ones.

Planning ahead can help make your intentions clear and ease the burden on your family.

Don't leave your loved ones guessing. Book a complimentary 15-minute consultation with Stratus Legal to discuss your estate planning options and help avoid the potential consequences of intestacy.

👻 Some legal nightmares are scarier than ghosts.

An informal property settlement, a Will that hasn’t been updated, a contract you haven’t read properly, or a legal notice left unopened… these are the things worth ghosting less and dealing with sooner. 🎃

This October, we're shining a light on a few legal oversights that can lead to unnecessary stress:
⚖️ Family Law: Don't assume a 50/50 split is automatic.
📜 Wills & Estates: Don't leave your Will until “someday.”
🏡 Conveyancing: Know what you're signing before you commit.
📩 Legal Disputes: Don't let important notices or deadlines slip by.

The good news? You don't have to face the unknown alone. Getting the right legal advice early can help you understand your options and make informed decisions.

Let's leave the legal horrors in the past. 👻

📩 Get in touch with Stratus Legal to discuss your circumstances and explore your options before things get complicated.

🎬⚖️ Pop culture meets the law… with a little Halloween spirit. 👻

Some of our favourite movies are packed with legal storylines hiding behind the drama: family disputes, inheritance, estates, property, business deals and decisions that can change everything.

From The Addams Family and its unconventional family dynamics, to Beetlejuice and its haunted property chaos, Ready or Not and its unusual take on inheritance, and The Haunted Mansion with its mysterious estate and property at the centre of the story, there’s plenty for a lawyer to unpack. 🎃

And that’s what makes pop culture so fun. A fictional storyline can highlight real legal issues we encounter in everyday life, even if the real-world version is considerably less dramatic. 😅
Because unlike the movies, you don't get a script, a plot twist or a second take when it comes to important legal decisions. ⚖️

Swipe through our Halloween Edition of Pop Culture Meets the Law and see which legal issues you can spot. 👀

A separation is already a lot to process. Making a major financial move in the middle of it can make things even more complicated. ⚖️

Think twice before selling, transferring, buying, refinancing or making other significant changes to your financial position without first understanding how it could affect your property settlement.

Under Australian family law, a property matter involves identifying the parties’ property and liabilities, considering their contributions and circumstances, and determining what outcome is just and equitable. The process can involve assets such as the family home, investments, businesses and superannuation.

There’s also an ongoing duty of financial disclosure in property matters, meaning relevant financial information and documents need to be disclosed while the matter is being resolved.

So, consider this your reminder: before making a big financial decision during separation, pause and get advice first. A decision that feels right today could have consequences for your broader financial position tomorrow.

Know your options. Understand your position. Make your next move with confidence. Set up an appointment: https://calendly.com/stratuslegal/family-law?back=1

One day, the conversation with your parents about their wishes may become one of the most important conversations your family ever has. ❤️

With only 3 months left in 2026, there’s still time to have that conversation.

Estate planning isn’t simply about deciding who receives what. It can also help families understand a parent’s wishes and prepare for circumstances where they may no longer be able to make decisions for themselves.

And the Australian data shows there’s still a gap. 88% of Australians aged 65 and over surveyed reported having a Will, but only 52% reported having an enduring power of attorney.

Australia’s population is also ageing. The ABS projects that people aged 65 and over could account for 25% to 27% of the population by 2071, compared with 17% in 2022.

So perhaps the best time to ask, “Have you thought about your estate plan?” isn’t someday.

It’s while there’s still time to talk, listen and plan together.

What’s worse than Monday?

A conveyance that arrives with a plot twist. 🏡📑👀

One minute it’s “We’re buying a house!”
The next, there’s a contract clause, a deadline, a document you’ve never seen before… and suddenly your coffee isn’t strong enough. ☕😂

Property transactions can come with a lot of moving parts, but you don’t have to navigate them alone. Our conveyancing team is here to help keep things moving and make the legal side feel a little less overwhelming. ⚖️

👻 GHOST FROM THE PAST: CAN YOUR EX CLAIM AN ASSET THAT’S ONLY IN YOUR NAME?

Here’s where things can get a little spooky.

In Australia, having an asset solely in your name doesn’t automatically mean it sits outside the property settlement. When determining a property matter, the Court identifies the parties’ property and liabilities, considers their contributions, and considers their current and future circumstances before deciding whether it is just and equitable to make an order.

That can mean looking at more than just whose name appears on the title. The overall financial picture may include property, savings, investments, vehicles, debts and superannuation, depending on the circumstances.

🕸️ The takeaway? Don’t assume an asset is automatically “off limits” just because your name is on it.

If you’re separating or have questions about your property settlement, send Stratus Legal Group an enquiry. We’re here to help you understand your position and your options. ⚖️

What would you make more room for if the things you’ve been putting off were finally dealt with? 🌱

Spring has a way of reminding us to clear out what no longer serves us, organise what has been left unattended and make space for what matters.
The same can apply to your legal affairs.

An outdated Will. A Power of Attorney you have not reviewed in years. Important documents sitting in a drawer waiting for “the right time” to deal with them.

Taking the time to review these arrangements does not have to mean tackling everything at once. Sometimes, making room for what matters simply starts with taking the first step.

Clear the legal clutter. Keep what matters.

If you are ready to review your Will, estate plan or other important legal arrangements, call Stratus Legal Group on 03 5521 7222 to start the conversation.

Pen in hand? Pause. ✍️

Signing your Will is an important step, but the signature itself is only one part of the process.

Before you sign, it is worth taking a final look at whether the document reflects your wishes and whether the people named in it are still right for the roles you have given them.

Consider:
⚖️ Your beneficiaries
Are the people you want to benefit from your estate correctly included?
📄 Your executor
Is the person you have appointed still someone you trust to carry out the responsibilities involved?
🏡 Your assets and specific gifts
Have there been any significant changes that should be reflected in your Will?

Life can change, and so can the arrangements that once made perfect sense.
Before the pen hits the paper, make sure your Will says what you want it to say.

📞 Before you put pen to paper, let’s talk. Call Stratus Legal Group to discuss your Will and estate planning needs.
