My wife is a pretty understanding woman… You kind of have to be when you’re married to a defence lawyer.
Late calls. Last-minute issues. “Just one quick thing” that turns into an hour.

But when we got married, she drew a hard line: Phone on silent after 10pm. Which… fair.

At the time I thought — we’ll see how that goes.
Now?
I get it.

Because the work will always be there. Another call. Another matter. Another urgency. But your family? That time doesn’t come back.

So after 10pm — unless it’s truly urgent — the phone goes silent. And I’m just a husband. Just a dad. And honestly… that’s the balance.

Do Islamic wills legally stand up in WA?

Short answer: yes — they can.
But only if they are drafted and executed properly under Western Australian law.

A lot of people assume that if a will follows Islamic principles, that automatically makes it valid.

It doesn’t.

In WA, an Islamic will still needs to satisfy the legal requirements of the Wills Act 1970 (WA). Generally, that means it must be in writing, signed by the testator, and witnessed by at least 2 witnesses present at the same time.

So the real answer is this:

An Islamic will can absolutely operate in WA —
but it has to be a legally valid WA will first.

Here’s what people need to understand 👇

🔹 Religious wishes alone are not enough
If the document is not properly signed and witnessed, there can be real problems in probate.

🔹 Your executor may still need Probate
If the deceased owned WA assets such as real estate or bank accounts in their sole name, the executor will usually need a grant of probate before dealing with them.

🔹 Family provision claims can still happen
Even if the will is valid, certain eligible people may still challenge the estate for further provision under WA law. That is one of the biggest misunderstandings I see.

🔹 Bad drafting creates real risk
If you want your estate distributed in a way that aligns with your faith, it needs to be carefully drafted so it is both Islamically intended and legally enforceable in WA.

The takeaway?

An Islamic will is not separate from WA law.
It has to work with WA law.

Done properly, it can.
Done badly, it can create disputes, delay, and outcomes you never intended.

People assume once the order is made — it’ll just happen.

Reality? Sometimes one party delays, ignores, or refuses.

Here’s what you need to know 👇

🔹 Court orders are enforceable
This isn’t optional. Non-compliance can lead to penalties, enforcement action, or even substituted ex*****on by the Court.

🔹 You may not need their cooperation forever
If one party refuses to sign or engage, the Court has the power to step in and move the process forward.

🔹 Delay = risk
The longer it drags, the greater the financial exposure — especially if there’s a mortgage, rates, or market movement involved.

Why the occasional personal post?

Because if you only ever see the suit, the courtroom, the transactions… you don’t see the person. And those who know me, know — I’m actually a very private person.

I still get:
“I didn’t know you were married.”
“I didn’t know you had a kid… let alone another on the way.”

That’s intentional. I keep my private life and work life separate.

So why share anything at all? Because my marketing person says it matters.
It humanises me.
It makes me approachable.

And when people are:
• Facing serious legal issues
• Trusting someone with their defence
• Spending hundreds of thousands — sometimes millions — on property

That “he’s a real person” factor matters more than you think. And the reality?
Every time I post something personal:

📈 More enquiries
📈 Better clients

Which is the whole point of marketing.

So yes — sometimes it’s a bit tongue-in-cheek. Sometimes you might think, “Not sure his wife would approve of that…” 😅

But in WA, it doesn’t work like that.

A “gift” of property still comes with real legal and financial consequences 👇

🔹 Stamp duty still applies
It’s assessed on the market value — not what you paid (even if that’s $0).

🔹 You take on full responsibility
Council rates, strata levies, land tax — once it’s in your name, it’s all yours.

🔹 Finance still needs to be addressed
If there’s a mortgage, the bank must approve the transfer or require refinancing.

🔹 Centrelink / financial impact
Receiving property can affect eligibility depending on your circumstances.

🔹 Future disputes
If it’s not properly documented, what starts as a gift can turn into a family issue later.

I’ve seen situations where good intentions led to unnecessary problems — simply because it wasn’t structured properly.

A gift today can become a legal issue tomorrow… if it’s done the wrong way.
