The Commercial Tenancies (COVID-19 Response) Regulations 2020 came into affect on 29 May 2020 and with it, the new Commercial Tenancies Code of Conduct. Commercial tenants and landlords now have lease principles that must be followed when negotiating rent relief during the COVID-19 pandemic.

The Commercial Tenancies (COVID-19 Response)
Regulations 2020 came into affect on 29 May 2020 and with it, the new Commercial Tenancies Code of Conduct.

Commercial tenants and landlords now have lease principles that must be followed when negotiating rent relief during the COVID-19 pandemic. Further, the new Code of Conduct provides processes and timelines that must be adhered to and consequences for when they are not.

Liquor Licensing Updates: Western Australia

Temporary restrictions on sale of packaged liquor revoked

On 20 April 2020, the Director of Liquor Licensing revoked the temporary restrictions on the sale of packaged liquor across WA. As a result, the packaged liquor restrictions are no longer in place and licensees are not restricted to selling packaged liquor in the prescribed quantities.

Due to some of the coronavirus responses significantly impacting the liquor industry, the department has introduced a number of initiatives to support licensees and allow most premises to continue to operate in a manner that complies with social distancing guidelines and protocols.

The WA Government has announced a new package for land tax relief grants for commercial landlords.

To be eligible, commercial must provide rent relief that equates to a minimum of three months' rent and freeze outgoings to small businesses that have suffered at least a 30 per cent reduction in turnover due to . Landlords must also agree not to seek to recover this rent relief from at the end of the period.

Applications open 1 May 2020.
