Can your executor also be a beneficiary of your Will?

Yes, and it’s actually very common.

Your executor is responsible for administering your estate, while a beneficiary is someone who receives from it. The same person can do both.

The key is choosing an executor you trust and who is capable of taking on the role.

If you’re unsure who to appoint as executor, KM Legal can help you work through your options.

Can you leave one of your children out of your Will?

Yes - but making that decision in your Will doesn’t necessarily prevent that child from making a claim against your estate after your death.

Family provision claims can be complex and depend heavily on the individual circumstances. If you’re considering excluding a child, treating children differently in your Will, or you’re concerned about a potential claim against your estate, we can talk it through with you to make sure you understand the risks and your options.

A handwritten or homemade document may sometimes be recognised as a Will, but that does not make it a safe estate-planning option.

Problems commonly arise when:

• the document has not been signed or witnessed correctly
• its wording is unclear
• assets or beneficiaries are inadequately identified
• no executor is appointed
• different documents contain conflicting instructions

Determining whether an informal document is a valid Will may require an application to the Supreme Court which often creates the cost and uncertainty the document was intended to avoid.

If you have been named as the executor of a Will, you may be wondering what you actually need to do.

One of the first steps is to gather the available information about the deceased person’s estate. Useful documents may include:

• the original Will
• the death certificate, if available
• details of the deceased’s assets and debts
• recent bank and superannuation statements
• property documents
• details of beneficiaries
• any relevant correspondence

It is not unusual for some information to be missing at this stage. A solicitor can help you identify what needs to be located, whether Probate is likely to be required and what should happen next.

If you have been appointed as an executor and need advice, KM Legal can guide you through the estate-administration process.

WHAT HAPPENS AT AN ESTATE-PLANNING APPOINTMENT?

An estate-planning appointment involves more than providing names for a Will.

We'll ask about your family, assets, superannuation, property ownership and any circumstances requiring particular consideration. These might include a blended family, vulnerable beneficiary, business interest or loan made to a family member.

We'll also discuss:

• who should administer your estate
• how your assets should be distributed
• who should make financial, medical and lifestyle decisions if you lose capacity
• whether additional structures or protections may be appropriate

You don't need to have all the answers before the appointment. The point of coming to see us is to let us help make the right plan for you.

Do I need to apply for probate?

It’s one of the most common questions we’re asked after someone passes away, and the answer really does depend on the estate.

Whether probate is needed depends on what assets the person owned, how they were owned and the requirements of the organisations holding them.

Some estates need probate, while others can be administered without it.

If you’re not sure what you need to do, we can help you work out the next step.
