The Federal Court has found, in a Joint Liability Trial, that Coles’ “Down Down” promotions involved misleading conduct and representations in contravention of the Australian Consumer Law.

This decision is an important step toward greater transparency and accountability in supermarket pricing across Australia.

The class action filed by GMP Law, on behalf of lead applicant Mr. Benjamin Glenn Demery and the class, is focused on securing compensation for affected consumers who shopped at Coles (in-store or online) between February 2022 and May 2023.

Registration for the Settlement Distribution Scheme is now open.

If you received an affected Exactech shoulder, hip, or knee implant between 1 January 2003 and 5 September 2024, you may be eligible for compensation.

You must register to be considered for compensation, even if you previously registered your interest with GMP Law.

The claims deadline has been extended to Friday, 29 May 2026. This extension ensures that all potential group members, including those not previously registered, have the opportunity to participate and have their claims assessed.

Exactech Class Action - Important Update

Registration for the Settlement Distribution Scheme is now open.

If you received an affected Exactech shoulder, hip or knee implant between 1 January 2003 and 5 September 2024, and believe you may be affected, you may be eligible for compensation.

You must register for the Settlement Distribution Scheme to be considered for compensation. Registration is required even if you have previously registered your interest with GMP Law.

All claims must be submitted by no later than 8 May 2026 (Claims Deadline).
