Property disputes can arise between neighbours, co-owners, family members, landlords, tenants, developers, or parties to a sale or purchase.

Common issues include:

1 boundary and fencing disputes;

2 easements, access rights, and encroachments;

3 co-ownership disagreements;

4 unpaid contributions or maintenance costs;

5 disputes arising from property contracts;

6 caveats and competing interests in land;

7 leasing and possession issues; and

8 damage, nuisance, or interference with use and enjoyment of property.

These disputes can become costly and disruptive if they are not addressed promptly and strategically. Early attention to the legal rights, obligations, and available evidence can often assist in narrowing the issues and identifying a practical pathway to resolution.

Whether the matter involves negotiation, mediation, tribunal proceedings, or court action, a clear understanding of the property rights involved is essential.

Property disputes are rarely just about land — they often involve financial, personal, and long-term consequences.

A deceased estate can become far more difficult, costly, and distressing when proper estate planning has not been put in place.

Common issues include:

No valid will — assets may be distributed under intestacy rules, which may not reflect the deceased person’s wishes.

Family disputes — uncertainty about intentions can lead to conflict between spouses, children, blended families, or other beneficiaries.

Delays in administration — locating assets, identifying beneficiaries, and obtaining authority to deal with the estate can take significantly longer.

Unexpected tax or financial consequences — poor planning may reduce the value ultimately received by beneficiaries.

Business disruption — if the deceased owned a business, lack of succession planning can affect operations, ownership, and control.

Vulnerable beneficiaries left unprotected — minors, persons with disabilities, or financially inexperienced beneficiaries may require more structured arrangements.

Superannuation and insurance issues — these benefits may not automatically form part of the estate and can pass in unintended ways if nominations are not properly managed.

Estate planning is not only about preparing a will. It is about ensuring assets, responsibilities, and decision-making arrangements are structured clearly and effectively.

A well-prepared estate plan can reduce uncertainty, preserve family relationships, and make the administration of an estate more efficient when the time comes.
