What would you do if your visa was cancelled at the airport over a message you never read?

That's exactly what happened to our client at Brisbane Airport. A WhatsApp video — sent by someone else — was found on his phone. He had no idea it was there. Visa cancelled on the spot.

We took it to Federal Court. The court agreed the decision maker never asked whether he actually posed any risk. Cancellation quashed. ✅

⚖️ Visa Cancellation Quashed – A Recent Win for Our Client

We are pleased to share that the Federal Circuit and Family Court of Australia recently quashed a decision cancelling our client's student visa — a decision made just days before Christmas 2025.

Our client, an international student, arrived at Brisbane Airport and was found to have a single video containing objectionable material stored in a WhatsApp group chat on his phone. He had not downloaded or searched for the material. He was in Australia when it was sent to him, and he was unaware it was there.

Despite this, a delegate of the Minister cancelled his visa on the spot — the same night he landed.

The Court found that the delegate's decision contained a jurisdictional error. A key issue was that the delegate failed to properly consider the purpose of the visa cancellation power — which is primarily to protect the Australian community. On the facts of this case, there was no finding that our client posed any risk to the community whatsoever.

The Court held that, without a link between the cancellation and the purpose of the power, the delegate's reasons lacked an evident and intelligible justification.

The visa cancellation was quashed.

This case is an important reminder that visa cancellation powers are not unlimited. Decision-makers must exercise those powers in a way that is connected to their purpose — and where they do not, the courts can and will intervene.

🎆 A New Year's Eve Legal Victory 🎆
While most people were preparing to celebrate New Year's Eve, the team at Sultan Legal was in Court fighting for our client's future in Australia.

What happened?

Our client's visa was cancelled when he arrived at Brisbane Airport, and he was told he would be removed from Australia on December 31st - just days away.

The problem?
If he was removed, he wouldn't be able to properly fight his case. Imagine trying to instruct lawyers, attend hearings, and gather evidence from overseas with a 5-hour time difference, limited internet access, and no income.

Our response:
We immediately filed judicial review proceedings and argued for an urgent injunction to stop his removal.

The result:
Judge agreed with us and granted the injunction! 🎉
The Judge found serious concerns with how the decision was made and importantly recognised that "the right to judicial review becomes practically illusory" if someone is removed before they can properly exercise it.

Our client now has the chance to properly present his case at the final hearing.

This case reminds us why migration law matters:
