Welcome Spring!

Spring is often a time of new beginnings as flowers start to bloom and we say goodbye to winter.

As a probate lawyer I see lots of new beginnings.

I see people commence their new beginnings without their loved ones, often in a world that now feels strange and unfamiliar.

Being an executor can be overwhelming, particularly if you have not undertaken this role previously. It is imperative that you reach out to relevant people who can assist you with the role. If the deceased has an accountant, financial planner or solicitor reach out to them. The financial planner will be able to save you lots of leg work in advising you of their investments and other relevant financial information whilst the accountant will be across taxation matters. If the deceased had business interests it is even more integral that you tap into the resources that the accountant and financial planner can provide to you as it will make your role as an executor so much easier. A Probate Lawyer will be able to guide you through the process of applying for a Grant of Probate, Administration of a deceased's assets and distribution of the estate. Always remember you are not alone, you just need to reach out to trusted advisors.

Obtaining a Grant of Probate of a Will prepared using a Will kit can be more costly and time consuming.

This is particularly the case if there are issues with the Will, for example, it wasn’t properly executed or witnessed, there is no date or the provisions of the Will are unclear or ambiguous.

The Court may issue requisitions asking for additional information which will delay the Grant of Probate.

It really does pay to put in place a well drafted Will whilst you are alive as it will make the probate process so much easier for your executor when you are no longer here

Planning for the end of your life.

Some people find this too confronting or perhaps too morbid, others just don’t want to think about it.

To some it is a unique opportunity to organise their final farewell, their final legacy in their own way.

If you do have specific wishes relating to your final farewell be sure to list them in your Will or leave detailed instructions in your personal papers with a copy of your Will so your executor knows what your wishes are.

The more specific you are the better. For instance, if it is your wish to be cremated and your ashes scattered at your favourite holiday location document this wish so that people know.

If you want no fanfare and to be cremated privately and your ashes scattered remotely stipulate this. By providing clarity to those left behind you are alleviating them what could prospectively be emotionally painful decision making.

Many people say it must be really hard working in this area of law.

I tell them it’s not, I wake every day feeling very privileged to work in an area of law that I am passionate about.

It’s incredibly enriching helping clients through such an emotional time of their lives, to partake in a journey where they are saying goodbye to a loved one and often there are tears and laughter which connects us even more.

One thing that I have noticed become more paramount is a celebration of the person who has passed away.

Celebration of a life lived well, celebration of times shared together, celebration of the triumphs and the obstacles they overcame and a celebration of how blessed they were that their loved one was merely part of their life.

To hear the stories of their loved ones and how they are celebrated is a privilege in itself and for that I am thankful. So remember, even in hard times it’s important to celebrate.

Often people leave a Letter of wishes in their personal papers with their Will.

Although these wishes are not legally binding they are to give the executor guidance into what their wishes are.

They could include wishes in respect to their funeral and what ceremony is to take place, what music they would like played and list the people they would like to take a special part in their funeral.

As an executor it’s a good idea to check whether a Letter of Wishes was left to them by the deceased as such letter will provide the executor with invaluable guidance.
