What does the proposed 30% minimum tax on Testamentary Discretionary Trusts mean for you?

Following on from our brief reel, we’ve broken down everything you need to know (based on what we know so far) about this Budget announcement.

The Government is proposing a minimum 30% tax on taxable income of discretionary trusts, applying at the trustee level from 1 July 2028. This affects TDTs established after Budget night (13 May 2026). If your TDT is already operating, you are not expected to be affected.

And here’s the important part: a TDT Will still far outperforms a simple Will on asset protection, income streaming, succession planning flexibility, and protection for minor and vulnerable beneficiaries.

There are still unknowns as draft legislation hasn’t been released yet, but right now nothing is required at this stage.

The proposed 30% tax on testamentary trusts has a lot of people worried but before you make any decisions, let’s take a breath.

There is no legislation yet. What we have is a Budget announcement that still has to pass Parliament and these things can change significantly before they ever become law.

Until we know what the legislation actually looks like, making changes to your estate plan could be premature.

CASE UPDATE | A recent NSW Supreme Court decision is a timely reminder that restraint of trade clauses do not automatically do what employers intend.

For employers, the lesson is straightforward. The restrained area must be no wider than what is reasonably necessary to protect a legitimate business interest and must hold up against other documents the same parties have signed.
