Thinking about transferring your property to a family member?

It may feel like a simple gift, especially if little or no money is changing hands. But in NSW, a family transfer is not automatically exempt from transfer duty just because it is a gift.

Unless a specific exemption applies, transfer duty is generally calculated on the higher of the consideration given and the property's unencumbered market value.

A family transfer can also have tax, land tax, Centrelink, aged-care, estate-planning and mortgage implications.

After years of juggling full-time work, study and life as a busy mum of two, Hayley completed her studies at Macquarie University in June and has now officially received her conveyancing licence.
