Another great win for our client at the Full Federal Court Today. Our client as the applicant appalled from a decision of the Federal Circuit Court. A decision where the Administrative Appeals Tribunal to refuse a partner visa under section 65 of the Migration Act 1958 (Cth). The question before the Full Federal Court was whether the Tribunal failed to consider relevant evidence, in the sense of failing to give active intellectual conservations to it. Justice Murphy with reasons, allowed the appeal.

VICTOR EMERY CLUB AND BEARS MILESTONE - JAMES CAMPBELL 🐻

Congratulations to James Campbell, whose 5-wicket haul on Saturday not only marked yet another entry into the Victor Emery Club but also brought up his 250th First Grade wicket. He is only the 15th Bear to achieve this milestone for the club.

James’s 5/25 was the driving force behind a thumping 10-wicket win to finish the First Grade season in style, and was his ninth five-fa at the top grade. He finished the season with 33 wickets at an average of 20.

Congratulations James !!’

BEARS MILESTONE - JAMES CAMPBELL 🐻

On Saturday, James Campbell brought up his 150th First Grade appearance. This significant milestone comes in Jimmy's tenth season at the top grade and sees him trailing only the Aitken brothers in First Grade appearances for the club amongst active players.

A two-time winner of the Access RnD Bradman Medal, James has taken his 239 First Grade wickets for the club at an average of 27.20 with seven 5-wicket hauls. In the past three seasons Jimmy has been particularly deadly, claiming 41 wickets at 22.26 in 2018/19, 35 at 23.46 in 2019/20 and 18 at 20.94 this season.

James is supported by Oxbridge Legal Associates.

The Federal Court has held that travel comparison website, Trivago, misled consumers about cheap hotel rooms rates both on its website and in television advertising.The Court found that, from at least December 2016, Trivago misled consumers by representing that it would help them find the cheapest rates available for a given hotel. It is a well-established principle of the English common law that when money has been received by one person which in justice and equity belongs to another, under circumstances which render the receipt of it a receipt by the defendant to the use of the plaintiff, the latter may recover as for money had and received to his use. The action was, as Lord Mansfield said in Moses v Macferlan, “quasi ex contractu” and founded on an obligation imposed by law and accommodated within the system of formal pleading by means of the fictitious assumpsit or promise.

The principle extends to cases where the money has been paid for a consideration that has failed. Whether the action is based on an implied promise to pay, or on a principle designed to prevent unjust enrichment, the emphasis on justice and equity in both old and modern authority on this subject supports the view that the action will not lie unless the defendant in justice and equity ought to pay the money to the plaintiff.

This was our legal submission to the Supreme Court of NSW- Court of Appeal for our client on a landmark win just few weeks ago; Nagamuthu v Shanmugarajah [2019] NSWCA 288
