📌 Family Law Insight – Financial Disclosure: Is it Optional?

💬 “Do I really have to show them everything?”
Yes. You do.
In family law, full and frank financial disclosure isn’t just a courtesy—it’s a legal obligation.

🧾 Whether you’re negotiating a property settlement or preparing for trial before the Court, both parties are required to disclose all relevant financial information, including:

Income (from all sources)
Superannuation
Assets (held individually, jointly, or in trusts/companies)
Debts and liabilities
Any recent disposals or transfers of property
🔍 Why does it matter?
Because the court (and your lawyer) can only ensure a just and equitable division if the full financial picture is visible. Withholding disclosure can result in:

Costs orders against you
Agreements being overturned

⚖️ The principle is simple:
Transparency supports fairness.
Whether you’re settling privately or heading to court, disclosure is the foundation.

🛑 NEW COERCIVE CONTROL LAWS IN QUEENSLAND – HANNAH’S LAW 🛑

On 26 May 2025, Queensland officially criminalised coercive control under what is now known as Hannah’s Law. This historic legislation marks a major step forward in protecting individuals from patterns of non-physical abuse, including emotional, psychological, and financial manipulation.

🔹 For Individuals:
Coercive control is now recognised as a criminal offence, and victims are encouraged to seek legal guidance to understand how this law applies to their situation. People being investigated or charged with this offence need to understand this is a serious offence and are encouraged to seek legal advice immediately.

🔹 For Employers & Corporations:
Understanding this legislation is also crucial from a workplace policy and risk management perspective. Businesses should ensure their HR policies, training, and support systems reflect an awareness of coercive control—especially where employee wellbeing, domestic violence leave, or legal reporting obligations may intersect.

As a firm committed to both compassionate advocacy and corporate legal clarity, we can:
✔ Assist individuals navigating family law and domestic violence matters involving coercive control
✔ Guide businesses on compliance, duty of care, and policy updates

At Preston & Associates, we believe in the power of resolution outside of court. Here’s why it’s often the better path:

Less Stress: Court battles can be emotionally draining. Settling matters amicably helps reduce anxiety for everyone involved.

Greater Control: You have more say in the outcome when you negotiate directly, leading to solutions tailored to your family’s needs.

Cost-Effective: Legal fees can quickly add up in court. Resolving disputes outside of court often saves money in the long run.

Preserving Relationships: Keeping lines of communication open fosters a more cooperative atmosphere, which is crucial for co-parenting and family dynamics.

Faster Resolutions: Court schedules can be lengthy. Alternative dispute resolution methods can expedite the process.

Let’s work together to find the best resolution for your family.
