When did you last check the smoke alarms in your rental property?
Under NSW law, landlords are legally responsible for ensuring smoke alarms are working at all times across every storey of a rental property. This responsibility cannot be passed to a tenant through a tenancy agreement.
If a tenant notifies you that an alarm is not working, you have 2 business days to repair or replace it. Alarms cannot be removed or disabled under any circumstances.
For properties in a strata scheme, the tenancy agreement must clearly state who is responsible for smoke alarm repair and replacement.
This is not just a compliance checkbox. It is the safety of the people living in your property, and getting it wrong carries real legal consequences.
