Under the Family Law Act, a de facto relationship generally exists when two people (of the same or different s*x) have lived together on a genuine domestic basis, and the relationship isn’t a legal marriage.

Courts look at a range of factors to decide if this threshold is met — including the length of the relationship, whether you shared a home, finances, and how the relationship was presented to others.

Timing matters too: generally, a relationship needs to have lasted at least two years for de facto property claims to apply, though there are exceptions (such as when there’s a child of the relationship).
