There has been more news in the media of another IVF negligence claim. The Plaintiff is suing for alleged, “unnecessary and experimental” treatments that were carried out as a part of an IVF treatment regime in 2015 and 2016. It is alleged that the Plaintiff was hospitalised for psychosis and mania following the prescription of high dosages of a steroid medication by her IVF treatment provider. Unfortunately, we are seeing more and more cases of IVF negligence and part of this may be due to the commercialisation of IVF clinics. There is a significant amount of money to be made by clinics in providing fertility assistance to couples who are already in an extremely vulnerable position.

For our firm though, we believe the devastating story of 11 year old Alex Raichman deserves a much higher exposure. The care provided to this young boy and his family was, simply, not good enough. As Deputy State Coroner Harriet Grahame stated, this was a “meaningless and completely preventable tragedy”.

We welcome the launch of the Stillbirth Clinical Care Standard. Sadly, 6 babies are stillborn every day and according to the Australian Commission on Safety and Quality in Healthcare, evidence suggests that 20-30% of stillbirths could be prevented with optimal care. The aim of the clinical standard is to reduce the number of women experiencing stillbirth, reduce unwarranted clinical variation in the prevention and investigation of stillbirth and support best practice in bereavement care for parents following any perinatal loss. Until now, there has not been a consistent approach to empowering women to understand the risks of stillbirth and to open up discussion about prevention. Women have also reported vastly different experiences in terms of how they have been treated post stillbirth. Our firm hopes that this framework ensures avoidable stillbirths are prevented and that all women who experience a stillbirth receive the support that is needed. Many roads lead to a diagnosis of Autism but birth injury (in the absence of cerebral palsy) was not considered one of them, since the popular understanding even now is that Autism, at least in part, has a genetic origin. However, in recent times, mainly in overseas jurisdictions, there are signs that this may no longer be a dead end to a claim for compensation for cases involving birth injury due to problematic (or absence of) intervention during delivery, delayed access to C-section and pre-eclampsia.
