The Court of Criminal Appeal has restricted the admissibility of certain expert evidence as to doli incapax in criminal cases involving children under 14.

The Court of Criminal Appeal is the State's highest court for criminal matters. A person who has been convicted or who pleaded guilty and been sentenced by a Supreme Court or District Court judge, may appeal to the Court of Criminal Appeal.

Sayle Newson has appealed his conviction for murder and seeks a directed acquittal or in lieu a new trial. The Court will consider his appeal sometime later this year.

Derrick Hand former state coroner has passed away from cancer. Mark Ramsland remembers him not for his coronial work but as the magistrate he first appeared before in a hearing he had as a very young lawyer at Port Macquarie Local Court. He remembers principally his kindness as he introduced him to the police prosecutor who was against him during the morning tea break. Without breaching any ethical standards he encouraged Mark and took the time to listen. There should be more kindness in the profession. Vale Derrick Hand.

In the below case we successfully argued costs after a verdict of not guilty on all 19 counts on the indictment. The evidence given by the complainants (all biological children of our client) was found to be vague, inconsistent, substantially lacking in credit and contaminated by their mother. It followed that costs were awarded in a matter where proceedings should never have been commenced against our client.
