And somehow, the list keeps growing.

We’ve all heard it. 😂

“My friend got 70/30.”

“My sister kept the house.”

“My neighbour said if I move out, I lose everything.”

“My cousin said super doesn’t count.”

Here’s the thing. What happened in someone else’s separation does not determine what will happen in yours.

There is no automatic 50/50 split in Australian family law. Property settlements depend on the individual circumstances of each relationship, including the asset pool, contributions made by each party, current and future circumstances and whether the proposed outcome is just and equitable.

So while your neighbour’s cousin might have plenty of advice to give over a coffee, their divorce is not your legal precedent.

Every family is different. Every property settlement is different.

Get advice based on your circumstances, not someone else’s.

🪛 DIY Wills are a bit like flat packs.

They look simple enough.

Choose an executor.
Choose who gets what.
Sign it.
Done. ✅

And a cheap online Will can feel like a bargain.

Until someone actually needs to use it.

The problem is, Wills tend to be tested at the one time you are no longer around to fix them.

We’ve seen Wills that do not properly deal with the whole estate. Executors who are no longer suitable. Gifts of assets that were sold years ago. Signing issues that raise questions about whether the Will is even valid.

With a flat pack, getting the instructions wrong might leave you with a wonky cupboard and three mysterious screws.

With a Will, the consequences can be far more serious.

Suddenly, the money saved doing it yourself can be spent many times over trying to work out what was actually intended.

That is the problem with a Will that looks right.

You often do not find out that it isn’t until it is too late.

A Will is not just a document. It is the instructions your family is left with when you are not there to explain them.

👨‍👩‍👧‍👦 Who would step in to care for your children if you were no longer here?

It is one of those questions that is easy to put off, but for parents with children under 18, it is an important part of preparing a Will.

Choosing a testamentary guardian is about more than picking someone you trust. You also need to think about your children’s relationship with that person, where they live, their family circumstances, parenting values and what life might look like for your children in their care. 💗

There is also another important question. Should the person caring for your children be the same person responsible for managing their inheritance? 🤔
