Mediation can give separated parents a structured way to discuss parenting arrangements with the support of an independent practitioner.

The conversation may cover regular routines, holidays, changeovers, school, health care, travel and communication. The focus should remain on arrangements that support the children’s best interests.

In most parenting matters, Family Dispute Resolution is required before applying to the Court, unless an exemption applies. Safety and suitability must always be considered.

Our latest article explains the process, possible outcomes and how legal advice may help before mediation.

Superannuation can be an important part of property settlement after separation.

Relevant superannuation interests should be identified and disclosed. A superannuation split may form part of an overall settlement, but it is not automatic and it does not usually make the money immediately available as cash.

Valuation, formal drafting and trustee requirements may also need to be considered.

Do not overlook superannuation simply because it is not held in a bank account or available today.

FAQ: Am I entitled to half in property settlement?

Not necessarily.

Australian family law does not apply a fixed 50/50 rule to every property settlement. The outcome depends on the property pool, the parties’ contributions, their current and future circumstances, and what is just and equitable in the particular case.

That means the answer cannot be worked out from a percentage alone.

Early advice can help you understand what information is relevant and how the legal framework may apply to your circumstances.

Can I keep the house after separation?

It may be possible, but the answer does not sit with the home alone.

A property settlement may also involve the mortgage, savings, debts, superannuation, investments and other financial interests. Contributions, current and future circumstances, affordability and the practical steps needed to transfer or refinance the property may all be relevant.

There is no automatic rule that the home must be sold or that the person currently living there will keep it.

Our latest article explains the issues to consider before deciding whether retaining the home is realistic.

Our client came to us approximately six months after separation.

The parties had reached an agreement at mediation. The former husband would keep the house, make a payment to our client and complete a superannuation split.

Both parties had legal representation and agreed to streamline the process through a Financial Agreement. The agreement was completed in approximately five weeks, with the house transfer and payment completed separately afterwards.

The outcome was already agreed. Our role was to help formally document it through the selected legal pathway.

This example reflects one client’s circumstances. Every family law matter is different.

Reaching an agreement after separation is a positive step.

But an informal agreement may not provide the legal certainty or finality you expect.

Property settlement agreements may be formalised through Consent Orders or a Financial Agreement. The appropriate option depends on the circumstances, the agreement reached and the legal advice received.

Before signing anything, make sure you understand what the document does and whether it properly reflects the agreement.

You have reached an agreement about property after separation. What should happen next?

There are two main ways a property settlement agreement may be formalised: Consent Orders or a Financial Agreement.

Consent Orders are made by the Court by agreement. A Financial Agreement is a private agreement with specific legal requirements, including independent legal advice for each party.

One option is not automatically better than the other. The right pathway depends on the agreement, the assets involved and the advice received.

Divorce and property settlement are not the same process.

A divorce ends the marriage. It does not automatically divide assets, liabilities or superannuation, and it does not automatically formalise a financial agreement.

That distinction also matters because time limits can begin once a divorce becomes final.

If you are separated or divorced and your property settlement is unresolved, early advice can help you understand what needs to happen next.

Property settlement does not need to wait until after divorce, and strict time limits may apply.

Married parties generally have 12 months after a divorce becomes final to apply for property orders. Eligible de facto partners generally have two years after the relationship ends.

If those time limits have passed, Court permission is required and is not always granted.

Every matter is different, so it is important to get advice about the dates and circumstances that apply to you.
