💜 Some matters require more than just legal expertise; they require patience, understanding, and a team that works together to support their client every step of the way.

We're incredibly grateful for this kind feedback about Melina, Amy, and Kay, who worked together to assist with a complex family law settlement and property transfer.

At Coutts, we know that legal matters often overlap different areas of life, which is why having a collaborative team behind you can make all the difference. Knowing our clients feel supported, understood, and confident throughout the process is what makes what we do so rewarding.

Thank you for your trust and recommendation; it truly means the world to us. 💜

Being charged is not the same as being found guilty. ⚖️

In NSW, domestic violence allegations can have immediate consequences long before a court has the opportunity to fully test the evidence.

For some people, that can mean:
👨‍👧 Changes to parenting arrangements
🏠 Removal from the family home
💼 Employment impacts
📱 Restrictions on communication
⚖️ Months or years before a final outcome is reached

Domestic violence must always be treated seriously. Genuine victims deserve protection.

But this article explores an important question: how do we ensure serious allegations are properly tested and supported by evidence as early as possible, particularly when historical allegations arise during parenting disputes?

It's a discussion about balancing protection, fairness and due process and why both matter.

Business partner disagreements happen. The question is how you handle them. ⚖️

Shareholder disputes can occur for many reasons, including:

📈 Different ideas about the future of the business
💰 Disagreements over profits or finances
📋 Concerns about company decisions
🤝 Breakdowns between business partners
⚠️ 50/50 ownership deadlocks

When disputes aren't addressed early, they can affect day-to-day operations, decision-making, and the success of the business.

That's why understanding your rights and options early is so important.

💡 In our latest blog, Mel explains the common types of shareholder disputes, practical steps to take if one arises, and when legal advice may help achieve a faster resolution.

Thinking of buying an investment property? 🏡💰

Before you sign, remember this:
👉 You may be buying a tenant too.

Investment properties come with extra legal and financial responsibilities, including:

📄 Reviewing the contract properly
🏠 Taking over an existing tenant and lease
💰 Land tax, stamp duty, and future CGT considerations
🏢 Strata reports and by-law restrictions
⚖️ Landlord obligations after settlement

In NSW, it’s very much “buyer beware” so doing your checks before exchange is critical.

A good conveyancer can help you avoid costly surprises and make sure your investment starts on the right foot.

Thinking about going to court in NSW? ⚖️

One of the biggest surprises for people is how quickly litigation costs can increase, especially before a final hearing even happens.

Legal costs are often driven by things like:
📄 Preparing evidence
⚖️ Court documents and appearances
👥 Witnesses and expert reports
🧠 Ongoing negotiations
⏳ How long the dispute continues

And something many people don’t realise 👇

💰 Winning a case does NOT automatically mean all your legal fees are paid back by the other side.

That’s why understanding the financial risks early is so important before starting or continuing litigation.

The truth is, there is no fixed cost when it comes to litigation. ⚖️
No two disputes unfold the same way.

Some matters resolve after a few letters. Others can run for months or years through the court system.

One of the biggest misconceptions we see? 👇

💰 “If I win, the other side pays all my legal fees.”

Unfortunately, it’s rarely that straightforward. Even successful parties often recover only part of their legal costs.

That’s why understanding your financial exposure early is just as important as understanding the strength of your case.

📌 Save this if you’re involved in a dispute

The recent Campbelltown tragedy is devastating.

Public reporting says a woman and two children were found dead, and a man has now been charged with domestic violence-related murder. The matter remains before the courts.

This blog unpacks what happened and delves into the harder moral question underneath these cases: how do we hold two truths at once?

⚖️ Domestic violence allegations must be treated seriously
⚖️ Genuine victims must be protected
⚖️ Evidence still matters
⚖️ Each case must be assessed on its own facts

The legal system must avoid both extremes: disbelief that silences victims, and assumption that removes scrutiny.

⚖️ LAW WEEK | Kaisha Gambell

One of the biggest things Kaisha has learnt over the past 10 years as a lawyer is the importance of balancing empathy with duty.

As Head of Wills & Estates, Kaisha has seen a significant shift in estate administration. What was once largely procedural, focused on paperwork, timelines, and asset distribution, has become far more emotionally complex.

Behind many estate matters are years of unresolved family conflict, grief, trauma, and deeply personal relationships.

Kaisha says many clients are no longer just worried about “what they get”, they’re carrying emotional grievances and pain that have often existed long before the estate itself.

Learning how to support clients through those emotions, without escalating conflict, has become one of the most important parts of her role. One phrase she often says is:

“I’m not about to jump on your train,”

A reminder that while she deeply understands her clients’ feelings, her role is not to add fuel to conflict, it’s to guide people through difficult situations with clarity, professionalism, and care.

For Kaisha, being a better lawyer means helping clients navigate not only the legal process but the emotional weight surrounding it, too, with the hope of helping them find some peace on the other side.

At Coutts, we know law is never just about documents. It’s about people. 💜

⚖️ LAW WEEK | Luisa Gaetani

One of the biggest lessons Luisa has learnt as a lawyer is that every client carries far more than just a legal problem.

As Head of Family and Criminal Law and an Accredited Specialist in Family Law, Luisa works with people during some of the hardest moments of their lives; separation, parenting disputes, crisis, grief, and uncertainty.

She shared a case that has stayed with her forever: a mother navigating cancer treatment, a newborn needing special care, and a father who disappeared before later returning and seeking parenting time. As the mother’s illness progressed, legal decisions became even more urgent. Tragically, she passed away during proceedings, and Luisa found herself helping the maternal grandparents fight to ensure the child could attend their own mother’s funeral.

It was a reminder that behind every file is a family, a story, and people carrying unimaginable weight.

For Luisa, being a better lawyer means never forgetting the human side of the law, because sometimes people come to you not knowing what to do next, only knowing they need help.

At Coutts, that understanding matters. 💜

⚖️ LAW WEEK | Karena Nicholls

One of the biggest things Karena has learnt over her 20 years as a lawyer is the importance of being her authentic self.

As Head of Employment Law and Personal Injury, Karena works closely with people facing some of the most difficult and emotional moments in their lives. She says one of the hardest parts of being a lawyer is giving clients advice they may not want to hear, but need to hear.

Balancing legal compliance with ensuring clients feel genuinely supported is one of the greatest challenges of the profession.

Karena got into law because she has a real passion for helping people, guiding them through complex legal situations, standing by them through the process, and working toward the best possible outcome.

For her, being a better lawyer means being honest, approachable, and staying true to who she is.

At Coutts, we believe the best lawyers are the ones who lead with both expertise and authenticity. 💜
