Do you need a Will? What happens if you die without a Will?

If you die without a valid Will (known legally as ‘dying intestate’) a standard formula is used to distribute your assets pursuant to the Administration and Probate Act 1919.
Generally this will mean all your assets will pass to your spouse or children. However, the situation is more complex if you have separated (not yet divorced) and have a defacto partner, children from different relationships or die with no spouse and no children.
Having a valid Will is essential to ensure your personal assets are distributed in accordance with your wishes upon your death and will save your estate unnecessary legal fees.
