The Family Law Act states that the division of assets and property in a divorce must be ‘just’ and ‘equitable’. You shouldn't assume your assets will simply be split 50/50.⁠

Your assets will be combined into a pool. Once all assets have been declared, each parties' contribution will be calculated.⁠

⁠Once the contributions are measured, a number of factors are considered such as the age/health of each party, which party will take primary care of children, or whether one party has a higher earning capacity than the other. ⁠

Once these factors have been taken into consideration, the original percentages may change. A court can then decide whether this percentage or division is ‘just’ and ‘equitable’ under the Family Law Act.⁠

Although it may seem cost-effective, it can be financially and emotionally draining for your loved ones, should a 'homemade will' goes wrong. Before going homemade, you should consider the following:⁠

📝 Your wishes may not be carried into effect. A Will Kit is more likely to be challenged as it can easily be misinterpreted and ambiguous if not done correctly.⁠

📝 A Will Kit may not deal with your superannuation funds. Although some think that superannuation will automatically form part of their Estate and be distributed in accordance with their Will, it's not always the case.⁠

📝 A Will Kit may not cover all bases.⁠ There are many situations and circumstances that Will Kits don't take into consideration.⁠

The best way to prepare your Will, protect your wealth + ensure your wishes are adhered to, is to have your Will prepared by a lawyer.⁠

7 TIPS YOU MAY NOT HAVE CONSIDERED.

When you’re buying a home there’s no denying that there’s a lot to think about, but that doesn’t mean that the process needs to be stress-ridden. Here are 7 tips to help make your home-buying process as stress-free as possible.

1. Don’t believe the hype (good or bad). You’ll soon learn the real estate jargon, and be able to decipher whether it’s accurate descriptions or over exaggerations.
2. Visit the location and do some research. Take a trip around your potential new neighborhood to see if you actually like what surrounds your potential home.
3. Consider surrounding suburbs. If your dream suburb is too expensive, try looking in the postcode next door.
4. Talk to the experts. Talk to local agents to find out what’s happening in the market, and what you can realistically aim for.
5. Stay up to date on new homes and get in first. When you or your agent finds a bargain, you’ll need to strike while the iron’s hot.
6. Keep an eye on the market. Cooler periods in the housing market can be windows of opportunity, so it’s worth keeping an eye on the interest rates and market trends.
7. Inspect before you buy. With COVID almost completely gone, you don’t just have to rely on photos, so try to see the home before you make an offer.
