Blended families can make Wills more complicated. In NSW, step-children are not treated the same as biological or adopted children under intestacy rules, but they may still seek provision from an estate in limited situations.

Eligibility often turns on real dependence and the nature of the relationship, not just closeness. Even if eligible, the Court weighs many factors before changing a Will.

Do adult children automatically inherit from a parentโ€™s estate in NSW? Not necessarily.

A parent can leave an adult child out of their Will. But that is not always the end of the story.

In some situations, an adult child may be able to make a family provision claim (a court application asking for proper provision from the estate). Outcomes depend on the facts, including the childโ€™s finances, the size of the estate, the parent-child relationship (including any estrangement), and competing needs of others.

Common risks include:

A Binding Death Benefit Nomination is a written direction from a super fund member to the trustee of the fund, nominating who will be the beneficiary of fund moneys upon death.
