Separating and “just sorting the house out” between yourselves? That informal agreement could cost you tens of thousands in stamp duty.

Here’s the catch: property transfers between separating couples are only exempt from stamp duty if the transfer is part of a formal family law agreement, a binding financial agreement or a court order. A handshake deal doesn’t qualify. Neither does an email. Neither does “we already worked it out.”

QC Law doesn’t do family law. But we work alongside family lawyers every week to make sure the property side is documented the way the exemption requires, so the transfer goes through clean, and you don’t get a stamp duty bill that wipes out the equity you were trying to protect.

A lease isn't a standard document. Every landlord negotiates differently, and the terms around rent reviews, outgoings, make-good obligations, and early termination can vary enormously.
