FATIGUE AT SEA: COMPLIANCE IS MORE THAN A PAPER EXERCISE

BIMCO has launched an international survey examining operational crewing levels and compliance with seafarers’ work-and-rest-hour requirements.

The survey seeks practical information about:

• crewing levels and operational workloads;
• compliance with minimum rest hours;
• the accuracy of work and rest records;
• watchkeeping arrangements; and
• the effectiveness of current monitoring practices.

These issues are particularly relevant in Australia. AMSA has warned that fatigue poses a serious risk to vessel safety, crew performance and seafarer wellbeing. Importantly, complying with minimum rest hours on paper may not, by itself, adequately manage fatigue.

Shipowners and operators should ensure that:

✓ crewing levels reflect the vessel’s actual operational demands;
✓ watchkeeping arrangements allow meaningful rest;
✓ work and rest records accurately reflect the hours worked; and
✓ the Safety Management System addresses fatigue as an operational risk.

AMSA has stated that falsification of rest-hour records is unacceptable and that serious deficiencies may result in enforcement action or vessel detention.

More choice and easier access to AMSA medical examinations

AMSA has expanded its network of approved medical providers for STCW-qualified seafarers and coastal pilots.

Complete Corporate Health has joined the national network, with more providers expected to be added from August 2026. Sonic HealthPlus has also been re-appointed as an approved provider.

This should give seafarers greater choice and flexibility when arranging the medical examinations required to maintain their qualifications and continue working at sea.

The medical standards have not changed, and existing AMSA medical fitness certificates remain valid.

The expanded network applies to STCW-qualified seafarers and coastal pilots requiring an AMSA Certificate of Medical Fitness. It does not change the arrangements for domestic commercial vessel seafarers with near coastal certificates of competency, who can continue to obtain Form 1850 through a general practitioner where required.

Medical certification issues can affect a seafarer’s employment and livelihood. Pacific Maritime Lawyers assists with AMSA regulatory and certification matters, including difficulties involving restricted or refused certificates, delays, specialist medical evidence and return-to-work requirements.
