When someone is diagnosed with a lung condition, the focus is understandably on treatment, family, and planning for what comes next.

But for people who have worked around asbestos, silica, dust, fumes or other airborne hazards, there is another very important question: Could my work history be relevant?

This Lung Health Awareness Month, our dust diseases expert Victoria Keays explains why that question matters, the importance of telling your doctor your work history, and why it’s worth starting a record now.

During Lung Health Awareness Month, it is worth remembering that your lung health history can include more than symptoms and appointments.

Old jobs, renovations, DIY projects, dusty hobbies and exposure to asbestos, silica, fumes or fibers may all be relevant later.

Avoiding exposure may not always be possible.

If you are concerned about your lungs, speak to your GP. If you have questions about whether a lung condition may be connected to workplace or home exposure, our dust diseases team can help you understand your options.

Victim-survivors of childhood institutional abuse often believe it’s too late to do anything, especially if the abuse happened decades ago.

In many cases, that may not be true.

Recent legal changes in Victoria mean victim-survivors may have more options than they realise.

Institutions can now be held responsible in more situations, including where the person responsible for the abuse was connected to the institution but wasn’t a formal employee, and where the care or supervision of children was handed over to someone else.

These changes may help to remove barriers that have previously stopped victim-survivors from bringing a civil compensation claim.

It’s important to get legal advice before accepting an offer under the National Redress Scheme, as accepting redress stops you from bringing a future civil claim against the responsible institution.

If you or someone you support is unsure where they stand, getting informed advice is a practical first step.

Last week our Union Relationships Manager Carol Saunders connected with AMWU members in Shepparton at SPC, Fonterra, Tatura Milk, and Campbell’s Soups, engaging with members and explaining the services they have access to at Gordon Legal as AMWU members.

On Friday, Carol joined AMWU organiser Candice Tierney and ETU organiser Aaron Douglas as union members at the Campbell’s Soups factory took industrial action in their fight for a fair deal on wages and conditions. AMWU State Secretary, Tony Mavromatis, addressed the group.

We stand in solidarity with AMWU & ETU members as they fight for their rights and the future of secure jobs in Shepparton.

For more information on industrial action, head to our Instagram or TikTok profiles and watch our video by Partner and Head of Industrial Law, Marcus Clayton.

Class actions are a really important part of the Australian legal system. They give people the opportunity to join together and fight for justice against large organisations, where individual claims would be too costly to pursue.

Partner James Naughton gives us a quick explainer on how class actions work in Australia - watch now.
