Buyers: Sign and return your loan documents promptly, and double-check that your names match the contract.

Sellers: Submit discharge forms to the bank without delay.

Banks usually need about two weeks to process everything, so keep communication open with your lender.

For purchasers, contracts can include a building/pest inspection clause that lets you terminate if certain conditions are met, but these clauses often allow exit only for major structural defects or a major current infestation.

To gain more flexibility, consider having your legal representative draft a special condition that allows you to terminate if the inspection doesn’t meet your satisfaction, or request the vendor to address any major defects. Until recently, most contracts of sale for off-the-plan dwellings contained a time cap on how long the developer could take to complete the development. If the developer was unable to complete the dwelling and register the plan of subdivision within the agreed time frame or by a specified date, both buyer and the developer were at liberty to terminate the contract of sale unilaterally. The estimated time was commonly referred as “sunset period” and the provision in the contract of sale permitting rescission of contract was referred as “sunset clause”.
