We asked Matthew what one piece of advice he'd like to share with other Social Enterprises in South Australia: "Be open to learning from different ways of doing things. There’s a lot of power in that. I think sometimes we underestimate how much wisdom exists outside the usual models. Big companies, and even well-established social enterprises, could benefit from sitting back a bit and just… listening. Appreciating the different perspectives around them. There’s strength in that diversity if we let ourselves lean into it."

The ACCC has backed the move, and consultation is now underway. It’s not law yet, but it’s a big step in the right direction. We’ll be keeping an eye on what happens next.

It’s not just legal jargon, it’s a way to protect your business during tough conversations.

But here’s the catch: Just writing "without prejudice" doesn’t automatically protect you. It only applies when there’s a genuine dispute and a clear intent to settle it.

Open communication is important, but knowing when and how to use "without prejudice" can keep you on solid ground in case things go south.

Michael Hill was bound by the contract terms because their representative ticked a box and signed the agreement, signaling acceptance, even though they didn’t read the terms.
The court held that by ticking the box and signing, Michael Hill effectively incorporated the terms referenced in the hyperlink into the contract.
