Family Violence Information Matters More 🚨⚖️

The Court's Application – Enforcement form has been updated.
If a family violence order exists, the form now asks about it and requires the relevant order to be filed.

This reinforces an important feature of modern family law proceedings:
Safety concerns and family violence information need to be put before the Court clearly and early.

Divorce Hearings Are Going Online 💻💍

Need to attend a divorce hearing?

From 31 August 2026, divorce hearings requiring attendance before a Deputy Registrar are generally conducted by Webex using audio and video.

For many separating couples, this means less travel and easier access to the Court — but you still need to be properly prepared and ready to attend online.

Repeated Court Applications Are Being Restricted đź“‘

Parties will generally only be able to file one additional Application in a Proceeding without permission from the Court.

Further applications may require leave, although exceptions exist for urgent high-risk matters and applications by Independent Children’s Lawyers. Federal Circuit Court

Why does this matter?
Family law litigation needs to be planned carefully. Repeated interim applications may no longer be as straightforward.

New National Enforcement List 💰⚖️

Is your former partner ignoring property or financial orders?

From 21 September 2026, the Family Court introduced a National Enforcement List for family law financial and property matters.

The aim is to provide a more streamlined pathway where someone has failed to comply with orders — including obligations concerning property, money and financial settlements.

A court order is not simply optional.

If orders are not being followed, enforcement options may be available.

Deposit Rules Are Also Changing đź’µ

From 1 July 2027, the current early-release-of-deposit process will be replaced.
Instead, buyers and sellers will be able to agree to an early release by including an appropriate condition in the contract.

Agents will also be prevented from taking their commission directly from an early-released deposit before settlement or rescission.

Contract terms will matter more than ever.

Direction 123 starts on 31 October 2026.

What matters is generally the direction in force when the decision is made. This means some matters already before the Department or Administrative Review Tribunal may be decided under Direction 123 even if they started under Direction 110.

If you have a pending character case, now is the time to review your evidence and strategy.

Section 32 Statements Coming Earlier đź“„

From 1 June 2027, buyers will generally have access to the Section 32 Vendor Statement earlier in the sales process.

For auctions, it must generally be available at least 14 days before the auction. For private sales, it must generally be available within 14 days after advertising begins.

For purchasers, that means more time to review the legal details before committing.

Hate and Extremism Under Greater Scrutiny

Direction 123 introduces stronger guidance around hate-related conduct and extremist associations when character decisions are made.

The new framework also adopts a more cautious approach to future risk in some areas, using whether a person “might” engage in certain conduct rather than the previous formulation.

Character cases are becoming increasingly evidence-sensitive.

Sold Prices Must Be Published 🔑

For properties becoming unconditionally sold from 1 October 2026, agents must update the Property Price Statement with the actual sold price within 7 days.

That information generally needs to remain publicly available for at least 18 months.

This gives buyers better access to real sales data, not just advertised prices.

Stronger Focus on Family Violence

Direction 123 places greater emphasis on domestic and family violence, including broader forms of abusive conduct such as coercive control and image-based abuse. No Worries Migration

For applicants or visa holders with relevant allegations, findings or convictions, these issues may receive greater weight in future character decisions.
