This is an interesting decision by Justice O’Bryan of the Federal Court of Australia. Uber was fined the “lower” penalty of $21 million for misleading consumers. The case was lodged by the ACCC after Uber admitted its conduct had misled or deceived consumers about their fare estimates and trip cancellation fees. The decision demonstrates how misleading consumers can lead to substantial consequences.

Uber is fined $21 million by the Federal Court for misleading customers about their fare estimates and trip cancellation fees — a penalty lower than the company had expected.

The NSW government introduced special regulations, the Electronic Transaction Amendment (COVI-19 Witnessing of Documents) Regulation 2020, that allow (on a temporary basis) for the remote witnessing of certain documents such as affidavits, wills, deeds and statutory declarations.

The Regulations permit remote witnessing of signatures and attestation of documents by audio visual link (eg WhatsApp, FaceTime and Zoom) provided certain conditions are met, including that the witness must:
1. observe the signatory sign the document in real time (eg witnessing the hand of the signatory sign the document);
2. confirm they witnessed the signature, either by signing a counterpart of the signed document, or, where the signatory scans and sends a copy of the signed document to the witness electronically, by countersigning that document;
3. include a statement specifying the method used to witness the signatory’s ex*****on and that the document was witnessed in accordance with the Regulations; and
4. be reasonably satisfied the document they sign is the same document/copy of the document, that they observed the signatory sign.
