Transfer is a legitimate treatment option. Contracts, insurance and outsourcing all belong in a risk framework. But under Australian WHS law a business cannot contract out of its primary duty of care, and outsourcing an activity does not outsource the obligation.

Where duties overlap, the law requires duty holders to consult, cooperate and coordinate. That is the opposite of handing the problem over.

That is what a mental health condition claim looks like in Australia.

Across all serious workers' compensation claims the median is $16,300 and 7.4 weeks. So a psychological injury claim costs more than four times as much and takes nearly five times as long to resolve.

Mental health claims rose 14.7% in a single year and now make up 12% of all serious claims.
