Many people currently hold, or have held a working with children check at some point in their life, weather this be a voluntary check for the purpose of volunteer work, community engagement or to be involved with local sporting clubs/terms, or in the alternative a ‘paid’ check for the purpose of paid employment.

Most people adopt the ‘set an forget’ mentality in relation to their checks, however many people are unaware of the ongoing reporting obligations that are imposed on them and other government bodies as to the ongoing compliance checks conducted on an individuals suitability to continue to hold a valid check for either a volunteer or paid employment position.

Pursuant to the Working with Children Act 2005 (‘the Act’), each and every holder of a working with children’s check is required to uphold various ongoing reporting obligations, this encompasses what the legislation describes as a ‘relevant change in circumstances’, such a change must be reported to the Department of Justice by the card holder, failure to do so can incur criminal penalties of up to 60 penalty units for each charge.
