The lawyer has been referred to the legal services board "in the public interest". Unlucky. But it is so important for us to learn from this and ensure it does not happen again.

AI in the courtroom and legal implications

In Handa & Mallick [2024] FedCFamC2F 957, the case centers around an enforcement application related to property orders made in November 2023. During the hearing, the husband’s legal representative submitted a list of authorities that was inaccurate, generated by legal software using AI. The court questioned the conduct of the solicitor and ordered submissions on why he should not be referred to the Legal Services Board. The hearing was adjourned for further negotiations and consideration of potential cost applications against the solicitor.

Post family law amendment parenting case
In Carlyon & Graham [2024] FedCFamC1F 443, the mother sought to change parenting orders made in 2022 claiming a significant change in circumstance, as a result of the child being traumatised by the father's car hitting the mother whilst the child was in the car with him.
The father was convicted of a traffic offence relating to this incident.
The mother's application was dismissed.
Firstly the mother based her evidence on "belief" that the child suffered harm instead of relying upon fact and she took over a year after the car accident to make an application.
The Judge found the existing parenting orders continued to facilitate a meaningful relationship between both parents and the ultimate harm to the child is the continued litigation between the parties.

Nope, says court! In Bartres & Bartres [2024], the Federal Circuit and Family Court of Australia shut down Mr. Bartres' attempt to nullify his marriage. Australian law says the Singaporean divorce counts, regardless. Was he just dodging a pricey property settlement?
