One of the many legal services we provide at Hendersons Legal are building contract reviews for home owners. 🏠🏡

Building contracts are crucial legal documents that outline the terms and conditions of the construction of a home or renovation. When we complete a contract review, our aim is to ensure that the contract strikes a reasonable balance between the home owner and the builder.

We recently reviewed a building contract that had over 90 special conditions which will gravely affect the rights of the home owners – these clauses are drafted by the builder, to solely protect the builder. They need to be carefully reviewed and amended.

Every contract we have reviewed we have recommended changes to the home owner to protect their rights. This includes our office:
• Confirming builder and director registrations; insurance eligibility; and the Victorian Building Authority disciplinary register.
• Checking the specifications, plans and other documents generated by the builder for unfair or unreasonable terms hidden in the fine print.
• Ensuring that the builder has provided all relevant mandatory consumer notices.
• Checking the appointment of the building surveyor appointment.
• Reviewing and advising on the critical special conditions.
