You did the extra work. That does not automatically mean getting paid for it will be easy.

The real fight often becomes:

Who asked for the work?
What exactly changed?
Was the contract process followed?
Was notice given?
Can the extra cost or delay be shown clearly?

The work on site might be obvious.

The paperwork around it might not be.

The stronger the record, the stronger the position.

The end of the project is a terrible time to discover nobody knows where the records are.

Final accounts are still open.

Variations are unresolved.

Delay issues remain.

Then the team starts digging through inboxes, comparing document versions and trying to work out which instruction was final.

That work should already have been done.

At the end of the project, you should be checking the record, not rebuilding it.

The live project test:

What notice is due?
What record is missing?
What deadline is closest?

If the answer lives across people, inboxes and memory, the process is exposed.

That is where legal risk starts to build.

Missing a notice gives the other side something else to fight about.

Was it sent on time?

Was it sent to the right person?

Did it say what the contract required?

Was it sent the right way?

Every contract is different, and missing a notice does not always mean the same thing.

But waiting until the deadline has passed puts you in a harder position.

Your project is delayed five days. Does that automatically mean you get a five-day EOT?

Not necessarily.

One reason could be the float.

This becomes important very quickly when delays start affecting the program and EOTs are being worked out.

Memory is not a project record.

A delay happens.

Someone gives an instruction.

Extra work gets done.

If nobody records it at the time, the details start disappearing.

Dates get fuzzy. People remember things differently. The link between the event, the cost and the delay becomes harder to prove.

Record it while it is fresh. Keep the documents. Follow the contract.
