An Important Reminder on Professional Responsibilities for Registered Migration Agents and Education Agents.

Recent OMARA enforcement action is an important reminder for everyone working across Australia’s migration and international education sector.

For Registered Migration Agents, our MARN carries significant professional responsibility. It should never be shared, lent, or used to allow an unregistered person to provide immigration assistance.

For education agents, counsellors, case officers and support staff, it is equally important to understand the boundary between education-related assistance and regulated immigration assistance.

Education agents play a valuable role in supporting students with course selection, admissions and enrolment processes. However, visa eligibility assessments, migration strategies, interpretation of migration law or policy, and substantive immigration advice must remain with appropriately authorised professionals.

For migration practices, this is a timely opportunity to review:

• staff roles and responsibilities
• supervision arrangements
• access to ImmiAccount and migration systems
• use and control of MARN details
• client communications
• file management and record keeping
• the distinction between administrative support and immigration assistance

This should not be viewed as a message of fear, but as a reminder of our shared responsibility to maintain high professional standards.

Strong compliance protects our clients, our businesses, our professional registrations and the reputation of the migration and international education sectors as a whole.

Education Agent ≠ Migration Agent
Administrative Support ≠ Immigration Assistance
Professional responsibility cannot simply be delegated.
