Uncle Pabai and Uncle Paul – First Nations leaders from remote islands in Guda Maluyligal in the Torres Strait – are taking the Australian Government to court for failing to prevent climate change.

They are arguing the government has a legal ‘duty of care’ to ensure Torres Strait Islander People are not harmed by climate change and are seeking a court order requiring the government to prevent this harm by cutting greenhouse gas emissions – in line with the science.

Residents in remote Northern Territory communities have filed a class action against the Northern Territory public housing body, represented by Phi Finney McDonald and remote housing advocate Daniel Kelly.

The case alleges the Chief Executive Officer (Housing) has failed to maintain public housing in remote Aboriginal communities and that the housing is not safe, habitable, or secure, with tenants paying excessive rent for housing that does not meet basic minimum standards.

The CBA class action trial is wrapping up this week in the Federal Court.

Phi Finney McDonald is representing a group of investors who lost money when CBA’s share price fell following an AUSTRAC announcement regarding alleged non-compliance with anti-money laundering and counter-terrorism financing laws. It is alleged that CBA was aware of these non-compliances as early as June 2014, but did not disclose this to investors.

This case is one of the most significant of its kind. The next step is for judgment to be handed down.

Congratulations to Auroramålet and the young people of Sweden for bringing this class action against the Swedish government.

Climate action is a legal duty, and governments need to take bold and urgent action to reduce greenhouse gas emissions.
