This is one of the many risky situations you could face as an agency.

While rental providers are legally responsible for ensuring their property meets all prescribed minimum standards, agencies can still be exposed if they advertise or enter into agreements for non-compliant properties.

Under Section 65A(1) of the Residential Tenancies Act 1997 (Vic):

“A residential rental provider must ensure that the rented premises comply with the rental minimum standards prescribed by the regulations on and from the day on which the renter enters into occupation of the rented premises under a residential rental agreement.”

If a rental provider refuses to carry out the required works, the safest steps are to:

• Clearly document the property’s non-compliance
• Provide written advice to the rental provider outlining their obligations
• Keep evidence on file to protect your agency from liability

PCV’s inspections and certification give you the formal documentation and reporting you need to:
