The Supreme Court of Victoria has handed down a landmark medical negligence decision concerning a patient’s right to provide free and voluntary consent. The Court found in Gawthorp v Bendigo Health [2026] VSC 157, that the defendant hospital was liable in battery and negligence after a vaginal examination was performed without the patient’s free and voluntary consent. Increasingly, violent storms leave many areas of Victoria riddled with fallen or weak trees and branches. Serious injuries could result if a tree or branch were to fall on you.

While public liability claims (slip-and-fall claims) in controlled environments are straightforward, tree-related injuries present unique legal challenges for those seeking compensation.

If you’re injured on the road in Victoria and it wasn’t your fault, on top of your standard TAC benefits, you may also be eligible to lodge a common law claim.

Your injuries must be permanent and deemed serious, and someone else must have been at fault or caused the accident.

Common law entitlements include compensation payments for pain and suffering and for economic loss.

Claims are not always straightforward, and we’d always recommend having a highly skilled TAC compensation lawyer by your side.

A personal injury settlement can be a big relief, but it can also raise tax questions. The general rule is that common law compensation for personal injury isn’t treated as income, so it usually is not taxable.

The exceptions are important though: weekly payments for lost income can be taxed, income protection payments are generally taxed as income, and any income you earn after you receive your payout (such as bank interest, dividends, or capital gains) is taxable.

If you’re unsure what category your payment falls into, get advice early.
