🏡 Your home loan is approved! What's next before settlement?

Congratulations! 🎉 Getting your home loan approved is a big step towards owning your new home.

But before settlement day arrives, there are a few important things to remember:

✅ Check your settlement funds – Make sure you know how much money you need to contribute towards settlement and related costs.

✅ Stay in touch with your lender – Confirm that your loan documents and settlement arrangements are progressing as expected.

✅ Check your insurance arrangements – Review your contract and lender's requirements to make sure your property is appropriately insured at the right time.

✅ Keep in contact with your conveyancer – Make sure you understand your outstanding requirements, important deadlines and settlement arrangements.

A smooth settlement takes teamwork between you, your lender and your conveyancer. 🤝

At Prox Conveyancing, we assist buyers and sellers with Victorian property transactions, guiding them through the conveyancing process from contract to settlement.

🔑 When Can You Collect the Keys to Your New Home? 🏡

Imagine you’ve signed the contract, paid your deposit and can’t wait to move into your new home!

But can you collect the keys straight away? 🤔

Generally, you’ll receive the keys after settlement is completed, unless an early-possession arrangement has been agreed.

Here are 3 things to remember:

🔹 Signed the contract? That doesn’t mean you can move in yet.

🔹 Paid the deposit? You still need to wait for settlement.

🔹 Want to move in early? Make sure the arrangement is properly agreed and documented before making plans.

✨ A little planning goes a long way! Confirm the key handover arrangements with your conveyancer and real estate agent before settlement day.

Buying or selling property in Victoria? Prox Conveyancing is here to help make the process clearer and less stressful.

🏡 Buying a Property with Your Partner, Family Member or Friend? Have You Decided How You'll Own It?

Buying a property together is exciting! But before signing the Contract of Sale, there’s an important decision to make. 👇

Will you own the property as joint tenants or tenants in common?**

🔑 Joint tenants — generally, co-owners hold equal interests, and the right of survivorship applies.

🏠 Tenants in common — co-owners can hold specified shares, which may be equal or unequal.

The right choice depends on your circumstances and what you want to happen if one owner passes away or the ownership arrangements change.

Before committing, consider:

✅ How much each person is contributing.

✅ Whether you intend to own equal or different shares.

✅ What happens if one person wants to sell their share.

✅ Whether you need legal advice about a co-ownership agreement or estate planning.

💡 It's much better to discuss these matters before purchasing than to discover later that you had different expectations.

🏡 What if the property is damaged after you sign the Contract of Sale?

You’ve signed the contract, but settlement hasn’t happened yet.

Then something unexpected happens — a storm damages the roof, a pipe bursts, or part of the property is damaged.

What should you do? 🤔

⚠️ Don’t assume you simply have to accept the property as it is.

Before settlement:

🔹 Let your conveyancer know as soon as you become aware of the damage.

🔹 Take photos and keep records of what has happened.

🔹 Check the contract and understand your rights and obligations.

🔹 Discuss any proposed repairs, insurance issues or settlement arrangements before agreeing to anything.

A final inspection before settlement is also important to make sure the property is in the expected condition.

Every situation is different, so if something happens to the property before settlement, get advice before making assumptions.

🏡 Buying an Investment Property with an Existing Tenant?

Found a property you love, but someone is already renting it?

Before you sign the Contract of Sale, here are a few things worth checking! 👇

🔑 The existing lease — Is there a fixed-term lease or a periodic tenancy? Understand the current rental arrangements.

📄 The Contract of Sale — Check what it says about the existing tenancy and the arrangements that will apply after settlement.

🏠 Your plans for the property — Planning to move in yourself or renovate? Don't assume you can ask the tenant to leave immediately. The tenancy agreement and Victorian rental laws may affect your options.

💬 Get advice early — Have the contract and relevant tenancy details reviewed before committing, especially if you need the property to be vacant by a particular date.

Buying an investment property involves more than just the purchase price. Understanding the existing tenancy can help you make a more informed decision. 💚

🏡 Buying a property? Remember to check your deposit deadline!

It’s exciting when your offer is accepted — but don’t let the excitement make you overlook an important step.

Before paying your property deposit, remember to:

🔹 Check the amount and due date in your Contract of Sale.

🔹 Confirm the correct deposit holder and payment instructions.

🔹 Keep your payment confirmation.

🔹 Contact your conveyancer early if you’re unsure about anything.

⚠️ Missing the deposit deadline may have serious consequences under your contract, so don’t leave it until the last minute.

Buying a home involves many important dates. Having someone help you understand them can make the process feel much less overwhelming. 💚

At Prox Conveyancing, I help buyers and sellers navigate Victorian property transactions with clear communication and practical guidance.

🏠 The seller accepted your offer — can they still sell the property to someone else?

Imagine this…

You make an offer on a property.
The agent tells you the seller has accepted it. 🎉

You think, “Great! The property is mine!”

Then you find out another buyer is interested. 😟

So, can the seller still sell it to someone else?

It depends on where things are up to with the Contract of Sale.

🔹 An accepted offer is not necessarily the same as a signed and binding Contract of Sale.

🔹 Before a binding contract is entered into, the situation can be different.

🔹 Once a binding Contract of Sale exists, the seller has contractual obligations to the buyer.

👉 The key takeaway: Don’t assume that an accepted offer means the property is legally secured.

If you're buying a property, make sure you understand what stage the transaction has reached before relying on a verbal acceptance of your offer.

🏡 Buying property can move quickly — knowing where you stand matters.

🏠 What if you find a problem at your final inspection?

You’re about to settle on your new home. You attend the final inspection… and notice something isn’t quite right. 😟

For example:

🔹 There’s new damage to the property
🔹 Something that was included in the sale is missing
🔹 The property isn’t in the condition you expected
🔹 Rubbish or belongings have been left behind
🔹 Agreed repairs haven’t been completed

So, what should you do?

👉 Don’t panic — but don’t ignore it either.

The final inspection is an important opportunity to check the property before settlement.

If you find a problem, let your conveyancer know as soon as possible. Depending on the issue and the terms of the Contract of Sale, there may be steps that can be taken before settlement.

Every situation is different, so it’s important to look at the contract and the circumstances.

💡 A final inspection isn’t just about checking whether the house looks nice. It’s one of the last important checks before settlement.
