Recent federal budget discussions around trusts have raised important questions about Testamentary Discretionary Trusts (TDTs) - a common estate planning tool used in many Wills.

While they’re sometimes grouped together with family or discretionary trusts, TDTs serve a very different purpose. In many cases, they are designed to help protect beneficiaries and inherited assets after someone passes away, offering flexibility and protection for future generations.

Potential changes to how these trusts are treated could have significant impacts on estate planning strategies and the families who rely on them.

In our latest article, we break down what Testamentary Discretionary Trusts are, why families use them and why these discussions matter.

Sure, AI can write you a will in 30 seconds. But can it ask you the right follow-up questions, spot family risks, understand complex relationships or tell you whether what it produced is actually valid under Queensland law?

We’re seeing more people turn to AI and online templates for estate planning, and while it seems impressive, a Will is one of the most important legal documents you’ll ever sign.

A vague clause, missing detail or simple mistake can create massive problems for the people you leave behind.

Estate planning is more than just a Will. You need expert advice to also consider cover for guardianship, tax implications, superannuation, asset protection and planning for incapacity.

The reality is that good estate planning is rarely just about writing down who gets what. It’s about understanding family dynamics, protecting vulnerable beneficiaries, considering tax implications, planning for incapacity and making sure your wishes can actually be carried out.

AI can generate words. It can’t replace legal advice tailored to your life.

If you’re thinking about updating your Will, getting proper advice now can save your family significant stress later. Reach out to our team today - friendly humans with a passion for helping people plan ahead.

Recently, some of our team attended the STEP Australia National Trusts & Estates Conference - a leading industry event bringing together professionals from across the country to discuss the latest developments, challenges and practical issues in wills, estates and succession planning.

This year focused on the real-world complexities faced every day, with presentations from highly respected leaders in the field, including The Honourable Justice Debra Mullins AO. For our team, conferences like this are an important opportunity to continue learning, strengthen our expertise and ensure we’re providing our clients with informed, up-to-date advice backed by current industry knowledge.

A sincere thank you to STEP Australia for hosting such a valuable and well-run event over several days. It was fantastic to connect with other professionals in the industry, share ideas and have meaningful conversations with people equally passionate about this area of law.

And just quietly… they fed us pretty well too...
We're already looking forward to the STEP Queensland conference in September.

Recently, the Wakerley Legal team stepped out of the office for a planning and training day - reviewing our year, sharpening our goals, and investing in the skills that keep us delivering for our clients.
Great legal work is built on great teamwork. We're lucky to have both. We rounded out the day with a well-earned team dinner, and we're heading into the next stretch energised and ready to go. 💪
